I was thinking the exact same thing.
If he is fast enough to phase when the coke-head punched him, why not phase when the dude shot him, it was much slower, and the dude even paused a mili-second to give him time to do it.
The golden rule in comics once was, if there aint a body, then there was no death. Maybe he phased, and someone standing behind him was shot, and that was the blood spattered on Nikki.
I am thinking him alive, and Nikki and the kid are in on the hoax.

When you find a bullet fired from a gun that travels slower than a fist, I'd like to see it. He probably expected to be punched, but not to be shot.

Also if he phased the bullet would've hit someone else. If DL was only looking out for himself he probably would've phased. But he didn't want an innocent to be hurt so he didn't phase.
